Terms of Use
San Tan Developments LLC owns and provides Unlimited Civil. These Terms govern access to and use of Unlimited Civil, including its websites, applications, services, documentation, content, and related systems (collectively, the “Service”). By accessing or using the Service, you agree to these Terms. If you use the Service for an organization, you represent that you have authority to bind that organization.
1. Limited authorization
Authorized users receive a limited, revocable, non-exclusive, non-transferable right to use the Service solely for legitimate internal business purposes under these Terms and any written agreement. No ownership rights are transferred.
2. Ownership and reserved rights
The Service, including its software, source and object code, interfaces, layouts, workflows, graphics, documentation, databases, models, methods, and improvements, is proprietary and protected by copyright, trademark, trade-secret, contract, and other laws. All rights not expressly granted are reserved.
3. Prohibited conduct
You may not copy, reproduce, republish, distribute, sublicense, sell, rent, or create derivative works from the Service; reverse engineer, decompile, disassemble, decode, translate, or attempt to discover source code, non-public APIs, models, prompts, logic, or methods; scrape, crawl, harvest, index, benchmark, or systematically extract data or content; use automated tools except as authorized; bypass access controls, rate limits, or security measures; probe vulnerabilities without written authorization; share credentials; remove notices or watermarks; use the Service or its outputs to build, train, improve, validate, or operate a competing product or service; or access it for competitive analysis without prior written permission.
4. Accounts and security
Each user must use an individually assigned account, safeguard credentials, and promptly report suspected compromise. Activity may be logged, reviewed, suspended, or terminated to protect the Service, users, or data.
5. Customer information
You retain rights you lawfully hold in submitted information and grant the rights reasonably necessary to host, process, transmit, back up, and display it to provide and secure the Service. You represent that you have authority to submit it.
6. Confidentiality
Non-public features, documentation, pricing, workflows, test results, security information, and technical or business information learned through access must be protected from unauthorized disclosure and used only for permitted purposes.
7. Construction and estimating responsibility
The Service is a decision-support tool. Estimates, measurements, quantities, classifications, extracted information, calculations, recommendations, and generated content may be incomplete or inaccurate. Qualified personnel must independently verify all outputs against plans, specifications, addenda, site conditions, contracts, codes, and professional requirements. The Service does not provide engineering, legal, accounting, safety, or other licensed professional services.
8. Availability and changes
The Service may be changed, interrupted, limited, or discontinued. No uninterrupted or error-free operation is promised unless stated in a signed agreement.
9. Suspension and termination
Access may be suspended or terminated for suspected unauthorized use, security risk, nonpayment, violation, or legal necessity. Ownership, confidentiality, restrictions, disclaimers, liability, and dispute provisions survive.
10. Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, OR RESULTS.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE OWNER AND ITS AFFILIATES, OWNERS, EMPLOYEES, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, DATA, BUSINESS, OR OPPORTUNITY; BID OR ESTIMATING ERRORS; OR SUBSTITUTE SERVICES. AGGREGATE LIABILITY WILL NOT EXCEED FEES PAID FOR THE SERVICE DURING THE SIX MONTHS BEFORE THE CLAIM, OR ONE HUNDRED DOLLARS IF NO FEES WERE PAID, EXCEPT WHERE PROHIBITED.
12. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless the Service owner from claims, losses, and expenses arising from submitted information, misuse, violation, or infringement of third-party rights.
13. Governing law
Arizona law governs, without regard to conflict-of-law principles. Unless a signed agreement states otherwise, exclusive venue lies in state or federal courts in Maricopa County, Arizona.
14. Updates and contact
Updated Terms may be presented for acceptance. Legal notices and questions should be directed to the Service administrator or the contact in the applicable written agreement.
